1. Acceptance of Terms

By creating an account or using the Docket platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using Docket on behalf of a business, you represent that you have authority to bind that business to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Docket is a cloud-based business operations platform for service businesses, providing tools for client management, job scheduling, invoicing, payment collection, and team coordination. The Service is provided as-is and we reserve the right to modify features at any time with reasonable notice.

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Your Data

You retain full ownership of all business data you input into Docket (clients, jobs, invoices, etc.). We process this data on your behalf as a data processor. You grant us a limited license to store and process your data solely to provide the Service.

Upon account cancellation or termination, you may request an export of your data. We will provide this within 14 days of request. Data will be permanently deleted from our servers within 30 days of account termination.

7. Intellectual Property

The Docket platform, its design, code, and content (excluding your data) are the property of Ontario Window Cleaning and are protected by copyright and other intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the platform.

8. Uptime and Availability

We aim for 99.5% monthly uptime but do not guarantee uninterrupted availability. We may perform maintenance (with advance notice where possible) that causes temporary downtime. We are not liable for damages resulting from service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCKET AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Docket and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

Either party may terminate these Terms at any time. You may cancel your subscription via account settings or by emailing support@crewdocket.com. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law provisions. Any disputes shall be resolved in the courts of Ontario, Canada.

14. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
